These Terms of Use (“Terms”) govern your access to and use of the website, SMS/text messaging service, and related services (collectively, the “Services”) provided by Scout, Inc. (“Scout,” “we,” “us,” or “our”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Service

Scout operates an SMS-based service that connects clothing brands with creators (such as models and photographers). Brands describe what they need by text; we send opportunities to relevant creators, collect their YES/NO responses, and share contact details between matched parties once a creator accepts.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements and that any information you provide is accurate.

3. SMS / Text Messaging Program Terms

These messaging terms supplement these Terms and apply to your enrollment in and use of our text messaging program.

Program description

When you opt in, Scout will send you text messages related to the Services, including shoot opportunities, creator shortlists, selection requests, confirmations, and account or support messages.

How to opt in (consent)

You may provide your express consent to receive text messages by:

• Submitting a web form on our website that includes your mobile number and an affirmative agreement to receive texts; or
• Sending a text message to our number, or replying to a message from us, to opt in.

Consent to receive text messages is not a condition of purchasing any goods or services.

Message frequency

Message frequency varies and depends on your activity, such as the number of shoot requests or opportunities relevant to you.

Costs

Message and data rates may apply. Such charges are billed by and payable to your mobile service provider. Scout does not charge for the text messages, but your carrier’s standard rates and fees still apply.

Opt out and help

• Reply STOP at any time to cancel. After you text STOP, we will send a single confirmation message and will not send further messages unless you opt in again.
• Reply HELP for help, or contact us at support@scout.example or +1 (555) 000-0000.

Carriers and delivery

Supported carriers may change, and carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and is not guaranteed.

Privacy

Your information is handled in accordance with our Privacy Policy. We do not sell or share mobile opt-in data or consent with third parties for their marketing or promotional purposes.

4. Acceptable Use

You agree not to use the Services to:

• Violate any law or the rights of others;
• Send spam, harassing, fraudulent, or misleading messages;
• Impersonate any person or misrepresent your affiliation with anyone; or
• Interfere with or disrupt the integrity or performance of the Services.

5. Matches and Third-Party Dealings

Scout facilitates introductions between brands and creators but is not a party to, and is not responsible for, any agreement, booking, payment, or conduct between them. Any arrangement you enter into with another party is solely between you and that party.

6. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, Scout will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.

8. Changes to the Services and Terms

We may modify or discontinue the Services, and we may update these Terms, at any time. The “Last updated” date above reflects the most recent revision. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
